Welcome to Mental and Mindful Health by Shelly Johnson-Choong, LICSW, MSW. Throughout the privacy policy page, Mental and Mindful Health will be referred to “us,” “we,” “I,” “my,” or “our.” We respect the privacy of our users, (referred to as “user,” “you,” or “your.”). This respect crosses all lines of media, including this website and social media pages.

The purpose of this policy is to explain our policies and help you understand your rights regarding use of this website and other media used by Mental and Mindful Health, along with what information we gather and/or use.

Our main purpose in using your personal data is to provide and improve the services we offer to you. By using the service, you agree to the collection and use of information in accordance with this privacy policy. Please read and make sure you understand our policies and procedures prior to engaging with our site.

Personal Data:

While using our service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Email address

  • First name and last name

  • Usage Data

Usage Data

Usage Data is collected automatically when using our service.

Usage Data may include information such as your device's internet protocol address (e.g. IP address), browser type, browser version, the pages of our service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

This helps us determine what type of services interest you and how we can better serve you through our services.

When you access the service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We may also collect information that your browser sends whenever you visit our service or when you access the service by or through a mobile device.

We may use your data for the following purposes:

  • Any emails sent to shelly@mentalandmindfulhealth.com will have a return email address. Also, it’s important to note that the above email address is not encrypted and therefore is not considered confidential. Although I keep this email account private, I do not have control of the route it takes to end up in my box. Also, on a sidenote, although I do my best, I may not be able to respond to emails sent to this address. I cannot offer therapy, coaching, or any other therapeutic services through this or any other email correspondence.

  • When you download a free opt-in, we keep your name along with your email, with your permission, in order to send you newsletters that offer tips on mental, emotional, and spiritual well-being. We’ll also send you relevant information on books, classes, and coaching being offered by Mental and Mindful Health. You can unsubscribe from this free newsletter anytime by following the instructions on the newsletter. Our email marketing is through Flodesk and their privacy policy can be viewed at: https://flodesk.com/legal

  • When you sign up for a paid class, we will keep receipts for tax purposes.

  • If you post on social media, that information becomes public. Before you post anything to our social media pages, please think about the ramifications. My personal rule of thumb is that I don’t post anything on social media that I wouldn’t want plastered on a freeway billboard. We discourage you from posting any kind of personal information, contact information, such as email addresses, phone numbers, street addresses, etc.

  • We have the right to delete any post that we consider inappropriate for the audience of Mental and Mindful Health. 

  • We do not control social media platforms, such as Facebook, Instagram, or any others in terms of what information they collect when you interact with our social media pages via these platforms. You can find the Facebook Privacy Policy here: https://www.facebook.com/privacy/explanation.

  • We also ask that you use professional sense when posting on our social media pages. This means you must refrain from bullying, advertising, use of other’s information, threats, telling stories that are not your own, or posting anything else that doesn’t seem like a good idea or could hurt or expose another person. Please, think before you post.

  • Our association with third party contractors is limited, but it does exist. Our privacy policy does not apply to these third-party contractors, and we do not have control over how they gather or use information. You will need to refer to their privacy policy for that information.

  • If you participate in coaching, your personal data will also be shared with Therapy Notes. Therapy Notes is a HIPAA compliant platform designed to be used by healthcare providers to keep track of their clients, their clients’ needs and progress. You will learn more about them when you sign up for private coaching.

Retention of Your Personal Data

Mental and Mindful Health will retain your personal data only for as long as is necessary for the purposes set out in this privacy policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Mental and Mindful Health will also retain usage data (as explained above for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods.)

Transfer of Your Personal Data

Your information, including personal data may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

The Mental and Mindful Health website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure services behind a firewall. All direct payment gateways offered by Wix.com and used by Mental and Mindful Health adhere to the standards set by the PCI-DSS as managed ty the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Mental and Mindful Health will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy and no transfer of your personal data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

If you are receiving coaching services from Mental and Mindful Health, we will be contacting you for appointment reminders and to collect fees or monies owed through Therapy Notes. You can read more about this through your client portal.

Deleting Your Personal Data

You have the right to delete or request that Mental and Mindful Health assist you in deleting the personal data we have collected about you. To do so, please contact us at shelly@mentalandmindfulhealth.com or send us a letter at 412 Town Center NE #131, Bella Vista, AR. 72714.

At that time we will delete:

  • Contact details

  • Activities

  • Orders

  • Invoices

  • Except for when necessary for tax purposes and according to the law

Disclosure of Your Personal Data

There are a few instances when we may need to disclose your personal data. That includes

  • A merger

  • Required by law

  • Other legal requirements such as to

    • Comply with a legal obligation

    • Protect and defend the rights or property of Mental and Mindful Health

    • Prevent or investigate possible wrong doing in connection with our services

    • Protect the personal safety of users of the service or the public

    • Protect against legal liability

If we work with another coach or coaching company, we may share your personal data. This can happen as we work together to create summits, seminars, combine newsletters, or other services that we believe would offer you better services. You can opt-out of this by clicking the link at the footer of our website that states, “Do Not Sell My Information.”

Children’s Privacy

Mental and Mindful Health does not knowingly collect personally identifying information for anyone under the age of thirteen. We discourage the use of this website, the newsletter, classes, and promotional material for children under the age of thirteen. If we become aware that we have collected personal data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers. If you are a parent or guardian of a child of this age, and you believe they have given us identifiable information, please let us know and we will review and delete this information.

Changes to this Privacy Policy

Mental and Mindful Health may update our privacy policy from time to time. You can learn about these changes by checking in with this page periodically.  Changes to this Privacy Policy are effective when they are posted on this page.
